1 - Preambule

These terms and conditions of sale are concluded between Vu Sur and any non-commercial physical or legal person ("You") wishing to make a purchase on the Website. They exclusively govern your relationship with Vu Sur.

Vu Sur reserves the right to modify the Terms and Conditions at any time. They will then be applicable as soon as they are posted online.

2 - Products

The products governed by these Terms and Conditions are those which appear on the Website and which are indicated as sold and shipped by Vu Sur. They are offered within the limits of available stocks.

The essential features of the Products are described and presented as accurately as possible.

3 - Price

The prices of the Products are indicated in FCFA (Francs CFA) all taxes included. They take into account the VAT and any reductions applicable on the day of the order.

The prices of the Products are exclusive of delivery costs (transport, packaging and making of the package according to the amounts in force). The amount of the delivery costs will be specified before the validation of the order.

If one or more taxes or contributions were to be created or modified, up or down, this change may be reflected in the selling price of the Products on the Website and on the various sales media.

However, a price cannot be changed once your order has been validated. However, in the event of a price error (price obviously paltry compared to the actual value of the Product), the validated order may be canceled by Vu Sur. This measure remains exceptional.

4 - Order

4.1 - Prior Identification

To place an order, you must identify yourself with your email address and / or your telephone number or your Facebook account. Your password will be asked later. For any first order, you must create an account.

4.2 - Registration and confirmation of the order

You have the opportunity to place your order online from www.vusur-market.com

Once your basket has been confirmed, you will have to choose the delivery city and the relay point, and choose your method of payment. Subsequently you will be asked to pay your order, this last step formalizing the sales contract between you and Vu Sur.

Any order implies acceptance of prices and descriptions of Products available for sale.

Vu Sur will acknowledge receipt of your order upon validation by sending you an email where you will find a summary of your order.

In some cases, including for lack of payment, wrong address or any other problem related to your account, Vu Sur reserves the right to block your order until the problem is solved.

In case of unavailability of a product ordered, you will be informed by email. The cancellation of the order for this Product and its possible refund, will then be made, the rest of the order remaining firm and final.

For any question relating to the follow-up of an order, You can consult your account on the Website or call 693 442 911 (cost of a local call) from Monday to Friday from 8h to 18h and Saturday from 9h to 17h.

5 - Payment

You can pay your order :

6 - Delivery

6.1 - Delivery in the ten regions of Cameroon

- Pelay Point

Delivery of orders is done in one of the 400 relay points of our logistics partner AfriRelay. These relay points are distributed in all cities of Cameroon. You will only have to choose the relay point closest to your place of work or place of residence. For the withdrawal of your package at a relay point, a valid ID will be required (CNI, passport or driver's license). Otherwise, the Products ordered can not be given to you.

In case of unavailability for the withdrawal of your packages, you can provide us by email the identity of the person to whom you give power of attorney for the withdrawal of your package. The latter will have to go to point equipped with his identity document.

7 - Return of products

7.1 - Exercise of the right of withdrawal

You have a right of withdrawal applicable at the time of withdrawal of your entire order. Indeed, Returns are made only in case of non-compliance of the item received. The verification must be done in relay point in the presence of the operator of the point. Thus, in case of nonconformity and desire to return, it will be necessary to signify it directly to the relay point operator and leave the package on the spot. In case of damaged Received Products, the procedure of Article 7.3 will apply.

All Products may be subject to withdrawal, except, for example, Products that have been customized on your request, Products that have been unsealed and cannot be returned for hygiene reasons (ex. : tights worn), audio or video recording products or computer software unsealed, fresh food products etc ... But it should be noted that the return is possible only in case of non-compliance of articles received.

Returned Products must be intact and complete and must not have been ported.

Seen on you will refund the returned Products. Please note that paid delivery charges will not be refunded.If You do not return your entire order and keep one or more Products ordered, you will not be refunded.

The refund will be made via the means of payment used during the returned order.

7.2 - Special case of a non-compliant product

Vu Sur advises you to check the products of your order at the time of withdrawal point relay in the presence of the operator of the point. In the event that the delivered Product is non-compliant (Product error, defective product, damaged or incomplete), the customer is invited to leave the package on the spot and to make reservations in writing or by call to Vu Sur before leaving the relay point.

In all cases, the provisions set out in article 8.1 on legal warranties will apply. Thus, the Product delivered nonconformity can be subject, initially, only a replacement or repair. Nevertheless, if despite all these steps, the new Product received does not suit you, you will be able to be reimbursed according to the terms and conditions in force.

For Products reported non-compliant relay point in the presence of the point operator, Vu Sur nevertheless allows you to exercise your right of withdrawal and obtain the refund of the Product pursuant to the provisions of Article 7.1, without passing by repair or replacement.

8 - Guarantees

8.1 - Legal Guarantee

All Products for sale on the Website are covered by the legal guarantee of conformity, allowing you to return defective or non-compliant Products delivered.

8.2 - Commercial Guarantee

Certain Products may benefit from a commercial guarantee called "Manufacturer Warranty" to which Vu Sur is not a party. Vu Sur cannot therefore be held responsible in case of refusal of the manufacturer to apply its warranty. The extent and duration of this warranty varies by manufacturer.

9 - Evidences

The computerized registers, kept in the computer systems of Vu Sur and its partners under reasonable conditions of safety, will be considered as proof of communications, orders and payments between You and Vu Sur.

The filing of purchase orders and invoices is done on a reliable and durable medium so as to correspond to a faithful and durable copy.

10 - Responsabilities

Vu Sur has for all stages of order taking as well as for the stages after the conclusion of the contract an obligation of result.

Thus, Vu Sur engages to describe with the greatest precision the products sold on the website. However Vu Sur is not responsible in the case where the non-execution of obligations are attributable to an unforeseeable and insurmountable fact or a third party to the contract as defined by the Cameroonian jurisprudence. Likewise, Vu Sur’s responsibility will not be imputable for all the inconveniences or damages inherent to the use of the internet, notably an interruption of services, an external intrusion or the presence of a computer virus.

11 - Personal data

Throughout your command, the personal data collected will be treated via a computerised processing.

12 - Applicables law ans jurisdictional competences

The General Conditions are subjected to the Cameroonian law. The competent tribunal in case of litigation will be that of the defender’s place of residence or at the option of the applicant or, as the article’s effective place of delivery.

The service Marketplace (“Vu Sur Market”), lauched by Vu Sur on her website www.vusur-market.com (“the Website”) has as objectif to connect purchasers who are not merchants (“the Clients”) with professional sellers (“Sellers”) proposing products at a firm price (“Products”).

Article 1 - Object

The following general conditions applicable to sellers (the "General Conditions") aim at defining the sales conditions subject to sellers registered on Vu Sur’s Market Place. They are available on the website.

Vu Sur reserves the right to modify the Terms and Conditions at any time. However, these new Terms and Conditions will not apply to transactions in progress at the time of their entry into force.

Note that Vu Sur cannot be considered as the seller of the Products purchased through the Marketplace and that only the Seller, whose identity is indicated on the Product Sheet and detailed is the Client's counterparty.

Article 2 – Provision of the MarketPlace by Vu Sur to sellers

Vu Sur has selected Vendors present on the Marketplace taking into account in particular the following non-cumulative criteria: geographical location of Vendors (Cameroon), Seller's Products, nature of Products, availability of Products (in stock at Vendors).

In addition, Sellers must be able to provide a good shopping experience to Buyers by (i) delivering correctly and on time (ii) respecting applicable laws, standards and regulations.

The commercial relations between the Sellers and Vu Sur are governed by a service contract which specifies the commitments that the Sellers are required to sell the Products on the Marketplace.

If a Referenced Seller fails to comply with one or more of the above conditions and more generally fails to meet its contractual obligations, Vu On reserves the right to unpublish the Seller's Product Catalog and terminate the contractual relationship binding them.

The use of the Marketplace by the Sellers is subject to a fee set in the service contract. This remuneration does not affect the ranking of Sellers' offers.

On the same product sheet, the Customer may have the opportunity to choose between different offers offered by Vu Sur and / or one or more Sellers.

Article 3 – Use of MarketPlace

Anyone can use the Marketplace. The Marketplace is for strictly private use. The use of the Marketplace by Internet users is free, without obligation of purchase. To acquire the Products offered for sale through the Marketplace, the Customer must proceed with the steps outlined in Article 6.

Article 4 – Product sheet

Each Product offered for sale through the Marketplace is described on a product page of the Website dedicated to it.

The Product Sheet contains the following elements :

  • The name of the Seller(s) proposing the Product possibly associated with the Seller's rating generated by the customer notices, with a link to the information relating to the identity of the Seller
  • Description of the Product and its essential characteristics
  • The price of the Product set by each Seller
  • Product availability
  • Product rating generated by customer reviews
  • The detail of customer reviews
  • The possible commercial guarantee granted by the Seller for the Product if necessary.

Article 5 – Prices of products

The price of the Products offered for sale through the Marketplace is set freely by each Seller of the Products, in compliance with applicable laws and regulations.

The price of the Products is indicated in FCFA all taxes included and is understood except delivery costs. The amount of delivery charges for each Product will be added before the validation of the order by the Customer.

The price of the Products is not negotiable by the Customer.

In addition, the price may be modified by each Seller at any time without the new price being applicable to the order already validated by the Customer.

Article 6 – Ordering products by the customer

6.1 Customer-s Prior Identification

The Customer must have the legal capacity to contract. To place an order, the Customer must identify himself with his email address and password.

Any Customer who does not hold a customer account will have to follow a registration procedure to obtain his customer account. This account is personal.

6.2 Registration and confirmation of order

Ordering Products through the Vu Sur Marketplace is only possible online, on the Website, and as follows :

  • The Customer adds in his basket the Products he wishes to acquire. Delivery charges will be added to the price of the Products
  • The Customer checks the details of his order and the total price indicated (price of the Products and delivery costs)
  • The Customer acknowledges the existence of an obligation to pay the order and then validates the order
  • The Customer indicates the delivery address of the order
  • The Customer proceeds to the payment of the order
  • Vu Sur transmits the order of Products to the Seller
  • The Seller confirms the order to Vu Sur or indicate its refusal, at the latest within two (2) days after the transmission of the order by Vu Sur; the refusal is only an exceptional case.
  • The Customer receives an email confirming or refusing the order

This last step formalizes the sales contract between the Seller and the Customer. Any validation of the order of Products by the Customer implies acceptance of the price of the Products.

For any question relating to the follow-up of his order, the Customer will have to contact Vu Sur customer service.

Article 7 – Payment of products by customer

Vu Sur Market offers several payment possibilities :

Upon confirmation of the order by the Seller, Vu Sur will cash the payment of the order by the Customer (price of the Products and transport costs) in the name and on behalf of the Seller.

Article 8 – Delivery of products by the seller

The Products may only be delivered to Vu Sur's partner points located in Cameroon, unless otherwise stated by the Seller of the Product.

Products will be transported at the risk of the Seller, so it will advise sellers to properly pack products.

The delivery procedure is as follows :

  • After confirming the order, Vu Sur indicates to the Seller the relay point, as communicated by the Customer; it is the Customer's responsibility to ensure that the relay point he has indicated is the one where he wishes to be delivered. Vu Sur and the Seller cannot be held liable for non-delivery of the Product due to an error on the relay point communicated by the Customer.
  • The Seller delivers the Products ordered directly to the indicated relay point.
  • The Customer receives an email from Vu Sur informing him of the Seller's delivery of the Products.
  • The Customer may contact the Seller at any time through Vu Sur to know the progress of the delivery of the order.
  • Upon receipt of the order, the Customer may exercise his right of withdrawal or report any claims concerning the Products (damage, non-compliance), as described and within the time limits
  • In the event that the delivery of the Products calls for reservations, the Customer may notify Vu Sur at the time of withdrawal of the parcel.
  • If the Customer has not received the Product on the expiration of the delivery period or delivery date communicated, the Customer shall inform the Seller through Vu Sur, to allow it a reasonable additional period of time to execute the command. At the end of this period, if the delivery of the Product to the Customer has not been made or if the Seller has not been able to deliver the order, and if the non-delivery is not attributable to the Customer (eg: transmission a relay point different from that where the Customer wanted to receive his product), the Customer may cancel, in writing, the sale by contacting the Seller directly, including through Vu Sur. The Seller will then ask Vu Sur to refund the price paid by the Customer.

Article 9 – Customer's right of withdrawal

Any Customer may retract in case of non-compliance of the item received. This must be noted at the relay point in the presence of a point operator. In case of return, the item will be returned to the seller and no charge will be paid to him for this article.

Note that all Products may be returned, with the exception of custom or custom-made Products, Products likely to deteriorate or expire quickly, Products which have been unsealed by the Customer after delivery and which may not be returned for reasons of hygiene or health protection, audio or video recording products or software that has been unsealed by the Customer after delivery, or any other product included under the legal exclusions. Products must not have been extended, washed or damaged and must be returned intact with any accessories, manuals and other documentation.

The Customer will exercise his right of withdrawal directly from the Seller through Vu Sur by informing him in an unambiguous way of his decision to retract, including by email.

It should be noted that the costs of returning the Products are the responsibility of the Customer, unless otherwise stated by the Seller.

In case of exercise of the right of withdrawal within the aforementioned period, only the price of the Products purchased(s) will be refunded.

Vu Sur will refund, following a request from the Seller, the Customer using the same means of payment as that used to make the order, the amount paid for the purchase of the Products, at the latest within a period of fourteen (14) days following the exercise of the right of withdrawal.

Article 10 – CUSTOMER CLAIMS - DISPUTES

In case of complaint concerning the delivered Products (damaged Products, Products not conforming to the order or to the Product Sheet, Missing Products etc ...), the Customer will have to contact the Seller, through Vu Sur.

The Seller will settle the dispute with the Customer, through Vu Sur. The Customer and the Seller will make their best efforts to reach an amicable resolution of the dispute. In the absence of amicable resolution, Vu Sur reserves the right to intervene in the resolution of the dispute, as a trusted third party.

The Customer must follow the instructions given by the Seller, including the terms of return to return the damaged or non-compliant Product.

After receiving the Product and noting the nonconformity or damage by the Seller, the latter will send either a new Product to the Customer, at no additional cost, or will indicate to Vu Sur to refund the amount received from the Customer for the purchase of this Product.

Article 11 – Product guarantees

11.1 Legal guarantee

All Products sold through the Vu Sur Market have the legal guarantee of compliance to return the defective Products to the Seller.

The Customer is informed that the Seller of the Product, is the guarantor of the conformity of the Products to the contract within the framework of these two legal guarantees. The Customer must contact the Seller through Vu Sur to implement these guarantees.

11.2 Commerciale guarantee

It should be noted that the commercial guarantee does not deprive the Customer of the provisions relating to the legal guarantee of conformity, as mentioned in article 11.1 of these Terms and Conditions.

Certain Products may also benefit from a "manufacturer" commercial guarantee to which the Seller is not a party. The extent and duration of this guarantee vary by manufacturer. The Customer can consult the exact terms of this possible warranty on the manufacturer's website and in the product manual.

It is reminded that the commercial guarantees do not apply in case of normal wear and tear (batteries, read heads, ...) or due to abnormal use of the Product, failures related to a bad connection of the device or not -respect of the instructions for use, shock, lack of use or maintenance or causes outside the Product (all cases of force majeure and in particular, lightning, water damage, etc.).

Article 12 – Liability

The Seller takes full responsibility for the Products that it sells through the Marketplace and will handle claims for the Products alone.

Moreover, Vu Sur being only an intermediary between the Seller and the Customer, the latter declines any liability relating to the sale concluded between the Seller and the Customer on the Marketplace. Thus, the Customer exempts Vu Sur from any liability that may arise in the execution of the sale, in particular as regards to the conformity of the Products, the conformity of the offer of sale, the conformity of the after-sales service, the ownership intellectual and industrial property rights relating to the Products.

Vu Sur can only be held liable to the Client for acts that are directly attributable to him as an intermediary and that have caused direct harm to the Customer. It is stated here that Vu Sur Market is not credited with the relationships created as part of the Marketplace.

The responsibility of Vu Sur and / or the Seller cannot be engaged in the event that the non-fulfillment of their obligations would be attributable: either to a bad use of the Marketplace by the Customer or by a fault of the latter, or to a fact unpredictable and insurmountable by a third; either to a case of force majeure as defined by the Cameroonian jurisprudence.

Similarly, Vu Sur's liability cannot be held liable for any inconvenience or damage arising from the use of the Internet, including an interruption or break in service, external intrusion or the presence of computer viruses.

Article 13 – Personal data

During visits on the Website, Vu Sur may ask the Customer for information through questionnaires, forms, especially when creating his account.

The requested information, marked with an asterisk (*), is mandatory. They are needed to process Customer requests.

This information is intended for Vu Sur, responsible for the processing, for the purposes of recording and processing the Customer's orders, managing the Client's customer account, marketing and statistical studies in order to provide the most suitable offers, service quality monitoring and commercial prospecting.

Vu Sur will send the Client his commercial offers by email, sms, phone if the Customer has accepted it, if the Customer has not objected to the collection of his data. The Customer reserves the right to oppose Vu Sur's commercial prospection at any time, free of charge, by logging onto the Website in its customer area.

Unless the Customer objects to the collection of his data, the information concerning the Customer may be communicated to Vu Sur's commercial partners who may send their commercial offers by email and telephone.

The information collected may be disclosed to third parties related to Vu Sur by contract, for the performance of subcontracted tasks necessary for the management of the customer account, orders and payments.

During the Customer's visit to the Website, Vu Sur wishes to place a cookie in the Customer's computer. A cookie does not allow Vu Sur to identify the Customer; on the other hand, it records information relating to the navigation of the computer on the Website (the pages consulted, the date and time of consultation etc ...) that Vu Sur will be able to read during the subsequent visits of the Customer. Vu Sur informs Customers that they may oppose the registration of cookies by configuring their browser from the "tools" and "options" menu.

Vu Sur may also be required to use the Customer's browsing data through cookies managed by a partner. The data used is strictly anonymous and is subject to purely statistical treatment. Thus the Customer will be able to see personalized banners.

Vu Sur implements all means to ensure the confidentiality and security of the data transmitted on the web.

Article 14 – Intellectual property

All elements of the Website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.

Thus, none of the documents from the Website may be copied, reproduced, republished, downloaded, posted, transmitted or distributed in any way, except under the following conditions: it is possible to download a copy of the documents on a computer for your personal use and only for non-commercial purposes, provided that you do not modify the information and that you keep intact all copyrights and other proprietary notices. The modification of these documents or their use by the Buyers for another purpose constitutes an infringement of the intellectual and industrial property rights of Vu Sur and the Sellers.

Article 15 – Proof, storage and filing of transactions

The computerized registers, kept in the computer systems of Vu Sur and its partners under reasonable conditions of safety, will be considered as proof of communications, orders and payments between the parties.

The archiving of purchase orders is done on a reliable and durable medium so as to correspond to a faithful and durable copy.

Article 16 – Illegal content or issue

Vu Sur reserves the right to remove any information or content that is clearly illegal from the Website. Customers are invited to notify Vu Sur of any type of information or illegal or litigious content by contacting Vu Sur Customer Service.

Article 17 – Full rights

In the event that any of the clauses of the Terms and Conditions become null or void by a change of law, regulation or court order, this shall in no way affect the validity and compliance with these General Conditions.

Article 18 – Law and jurisdiction

The Terms and Conditions are subject to Cameroonian law, without prejudice to mandatory legal provisions. The court of competent jurisdiction in case of dispute shall be that of the defendant's place of residence or, at the option of the plaintiff, the place of actual delivery of the Product.

Article 19 – Special provisions for certain categories of products

19.1 Alcohol

The sale of alcoholic beverages is prohibited to minors. Therefore, by validating his order for wine, champagne or other alcoholic beverages on the Website, the Customer acknowledges being eighteen (18) years old. Article 2 - Access to website

Article 3 - Customer account

Your customer account allows you to :

  • Consult and update your contact information;
  • Track your current orders and view the history of your last orders and refunds over the last six months;
  • Return an item and get a refund;
  • View the promotional offers you receive;
  • Make a list of your favorite products;
  • Set your options for sending advertising campaigns.

You will receive an email confirming the creation of your customer account and showing all of your customer data. It is specified that your logins (email address or phone number and password) are under your sole responsibility. It is your responsibility to ensure the confidentiality of this information, and to report any fraud or hacking to Vu Sur customer service as soon as possible. To delete your customer account, you are invited to contact Vu Sur customer service. It is specified that Vu Sur may also be required to delete a customer account that does not have an order in progress due to the regulation related to personal data.

Article 4 - Customer's review

4.1 Overview

Vu Sur has set up on the website a system of collection and publication of customer-s review allowing in particular :

  • To help other users to compare and choose the best product or the best seller
  • To adapt its offer and improve the quality of the Products or the selection of the Sellers.

Each Customer Review also has a rating between one (1) and five (5) stars. A general score is then assigned to the relevant Product or Seller corresponding to the arithmetic average of all Online Customer Reviews relating to the Product or Seller concerned.

4.2 Prerequisite

Only Customers who have made an order are likely to give their opinion on the Product ordered or the selected Seller.

As such, Vu Sur will send you an email following the delivery of your Product in which it invites You to leave your Customer Opinion on the Products purchased within the limit of five (5) Products, and / or on the Sellers concerned. If you wish to give your Customer Opinion, you will have to click on the link present in the email. You will then automatically be redirected to a form to comment on the selected Product or Seller. You will then be able to enter the contents of your Customer Opinion and note the Product (overall score, value for money, style, material ...) or the Seller (general note, quality of the product sheet, respect of delivery times, customer service satisfaction ...).

4.3 Identification of the author of the Customer Review

In order to publish a Customer Review, you must provide a username of at least four (4) characters.

Your true identity and more generally, any personal data concerning you, should never be communicated via your Customer Opinions. Otherwise, You understand that your personal data will be publicly available on the Site and accessible to any user. Vu Sur Market cannot be held responsible for such dissemination.

4.4 Access to Customer Reviews

The posting of a Customer Review is made no later than five (5) business days after you have submitted your Customer Review via the form, subject to the provisions related to moderation. Customer Reviews remain available on the Website as long as :

  • The Product concerned is accessible on the Website, provided that there is no change of supplier or the main characteristics of the Product rendering the Customer Review obsolete
  • The relevant Seller is referenced by Vu Sur Market on the Marketplace.

By publishing a Customer Review, You understand and agree that it (i) is publicly available on the Website and accessible to any user, and possibly to external users of the Website via search engines and (ii) is used by Vu Sur Market for the purpose of promoting, by any means and in any medium, Products, Sellers, the Customer Reviews system and more generally the Site (sending newsletters, etc.).

Article 5 - Commitment of the author of customer review

Any user can take note, thanks to the Customer Review, of the notation attributed by other users relative to a Product (qualities, defects) or to a Seller (delivery, customer service, etc.). As such, you agree to :

  • Post a useful Customer Review in the sense that it should help other users to compare and choose the best Product or the best Seller or, to Vu Sur, to adapt its offer and improve the quality of Products or the selection of Sellers.
  • Deliver non-misleading and relevant information, that is to say :
    • Relating to the Product itself (its qualities, its essential characteristics) and not the services related to the Product to which the Customer Review refers such as delivery, payment, return. We invite you, if necessary, to contact Vu Sur customer service at 693 422 911
    • Relating to the Seller itself and its services and not the qualities of the Product sold by the Seller to which the Customer Review refers
    • And more generally, not unrelated to the Product or Seller to which the Customer Review refers.
  • Do not use incomprehensible, unintelligible, and / or meaningless language or publish a Customer Review in a foreign language.

In addition, the content of the Customer Review must not :

  • Be contrary to the laws and regulations in place
  • Being contrary to public order and morality, including, without this list being restrictive violent, hateful, insulting, denigrating, defamatory, vulgar ...
  • infringe any right of intellectual property, industrial property, personality right or any other right held by a third party
  • Be inappropriate with respect to another Client Review or its author
  • Include personal and / or sensitive data
  • Include hypertext links
  • Present an advertising character or mention another company
  • Contain computer viruses, spyware, malicious ...

Article 6 - Moderation of customer review

Vu Sur executes a prior moderation. This means that the Customer Reviews are first evaluated and then posted on the Website. As such, the moderator of Vu Sur reserves the right to voluntarily remove any Customer Reviews that specifically violate the provisions of Article 5 and more generally to these Terms.

Moderation is carried out indiscriminately on all Customer Reviews, regardless of their content, and no later than five (5) business days following the submission of the Customer Review. You will then be informed by email of the reasoned decision of publication or non-publication of your Customer Review by the moderator of Vu Sur.

In the event that your Customer Review is not published, You will be able to write a new Customer Review on the Product or Seller concerned, if applicable, in accordance with these Terms and Conditions.

Once you have published the Customer Review, you will not be able to edit it. It is specified that Vu Sur has a right of reply vis-à-vis the published Customer Review. Vu Sur may also be required to contact you following the writing of a Customer Review and this as part of its monitoring of customer management.

Article 7 - Reporting abuse

You may at any time notify us of a Customer Notice that would violate your rights and / or contravene the TOS by contacting the moderator via the "Report" link under the relevant Customer Review. In this case, the Customer Review will be temporarily removed from the Website, until it has been subject to further verification by the moderator.

Article 8 - Personal data

The personal data collected on the Website will be subjected to computer processing.

Article 9 - Intellectual property

All elements of the Website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. Similarly, the trademarks, logos and designs appearing on the Site are the exclusive property of Vu Sur. Their disclosure shall in no way be construed as granting any license or right of use whatsoever to the said trademarks and distinctive elements protected by copyright. They cannot be used under penalty of forgery.

Thus, none of the documents from the Website may be copied, reproduced, republished, downloaded, posted, transmitted or distributed in any way whatsoever. However, it is possible to download a copy of the documents on a computer for your personal use and only for non-commercial purposes, provided you do not modify the information contained and keep intact all copyrights and other proprietary notices. The modification of these documents or their use for another purpose constitutes an infringement of Vu Sur's intellectual property rights.

If You have a personal website and wish to place, for personal use, on your website a simple link directly to the homepage of the Site, You must compulsorily ask the company Vu Sur. This will not be an implicit agreement of affiliation.

Article 10 - Liability

Vu Sur undertakes to ensure the proper functioning of the Website, however, its responsibility cannot be held liable for any inconvenience or damage arising from the use of the Internet, including a break in service, external intrusion or the presence of computer viruses.

Vu Sur will make its best efforts to avoid that Customer Review contrary to legal or regulatory provisions and more generally to these Terms is available on the Website. Customer Reviews are published under the full and sole responsibility of their authors; Vu Sur cannot be held responsible for content of which it is not the author.

Article 11 - Disputes

The Terms are subject to Cameroonian law. The competent court in case of dispute will be that of the place of residence of the defendant.
